Dr. Shafi donates arrears of his salary to purchase medicines for hospitals
Dr. Shihabdeen Mohamed Shafi, the doctor at the Kurunegala Teaching Hospital has decided to donate arrears of his salary amounting over Rs. 2.67 million for the purchase of essential medicines for hospitals.

Dr. Shafi who was on compulsory leave on charges of performing infertility surgery, has received a cheque of over Rs. 2.67 million salary arrears from the Health Ministry last week.

The salary arrears include the basic salary, interim allowance, cost of living, and allowance in lieu of pension for the period of compulsory leave imposed on Dr. Sihabdeen.

Dr. Shafi who was employed at the Kurunegala teaching hospital was arrested on May 25th, 2019, on charges of performing infertility surgery.
On July 25, 2019, the Kurunegala Magistrate’s Court ordered that the doctor be released on bail.

Health ministry to pay back-wages for Dr. Shafi before July 10

Court of Appeal grants bail on Hejaaz Hizbullah
The Court of Appeal today ordered to release Attorney-at-law Hejaaz Hizbullah on bail after nearly two years in detention and remand custody. Accordingly, the Court of Appeal directed the Puttalam High Court to release Hejaaz Hizbullah on bail with suitable bail conditions. Muslim families in the United Kingdom whose loved ones have been cremated in Sri Lanka have submitted a complaint to the United Nations, branding the South Asian country’s controversial policy “unjust and discriminatory” and calling for its immediate suspension.

Buddhist-majority Sri Lanka made cremation mandatory last March for people who die, or are suspected to have died, with coronavirus.

Christians bury their dead, too, and some in Sri Lanka have also been hurt by the move, which came despite World Health Organization (WHO) guidelines which permit burials for people who die from COVID.

The UK complaint was lodged to the UN’s Human Rights Council (UNHRC) on Friday by the Muslim Council of Britain (MCB) in partnership with UK-based law firm Bindmans on behalf of the families.

Zara Mohammed, the secretary general of the MCB, described the country’s cremation policy as “unprecedented”.

“No other state has carried out such unjust and discriminatory measures,” she said in a statement issued on Monday. “We very much hope that the Sri Lankan government will change its policy in line with the World Health Organization advice.”

Tayab Ali, a partner at Bindmans who represents the MCB and the families, described the practice as “heartless”.

“Our clients were already suffering from the distress of losing a family member to COVID,” he said in a statement. “It is truly heartless for the Sri Lankan government to add to that distress by unnecessarily forcing the bodies of loved ones to be cremated.”

Ali also called for the UNHRC to “take immediate action on receipt of this complaint by granting interim measures to halt these cremations”.

UN experts urge policy rethink
The complaint said there was “no justification, on the facts, for the prohibition of burial maintained by the Sri Lankan government”.

“This has been recognised by multiple institutions of the UN,” it said. “There are, as scientific experts have already advised, multiple protection measures that can be put in place to protect public health without the blanket denial of the right of individuals to practise their religion and to be buried in accordance with their faith.”

Sri Lankan officials have claimed that bodies of COVID victims would contaminate the groundwater if buried.

But several experts have countered this claim, noting that if burial locations are well planned, the groundwater would not be affected.

In January, an expert panel appointed by Sri Lanka’s Ministry of Health said burying those who had died from COVID-19 was allowed, in line with precautions to curtail the pandemic.

UN special rapporteurs, for their part, have twice called on Sri Lanka’s government to reconsider its mandatory cremation policy in letters sent to authorities in January this year and last April.

In their latest note, UN experts said the practice ran contrary to the beliefs of Muslims and other minority communities in Sri Lanka, and could “foment existing prejudices, intolerance and violence”.

The WHO has said there is no evidence to suggest that cremation prevents the spread of coronavirus.

“While we must be alert to the serious public health challenges posed by the pandemic, COVID-19 measures must respect and protect the dignity of the dead, their cultural and religious traditions or beliefs, and their families throughout,” the UN experts said.

Critics of Sri Lankan Prime Minister Mahinda Rajapaksa have accused his government of using the pandemic to marginalise Muslims, who make up roughly 10 percent of Sri Lanka’s 21 million people.

More than 70,000 COVID-19 infections have been recorded in Sri Lanka since the pandemic erupted, and 365 people have died after contracting the virus, according to data collated by Johns Hopkins University School of Medicine.

ශ්‍රී ලංකාව ස්වාධීන, ස්වෛරී රටක් බැවින් මේ රටේ අභ්‍යන්තර කාරණාවලට ජාත්‍යන්තර ඇඟිලි ගැසීම් අවශ්‍ය නැත. එවැනි ඇඟිලි ගැසීම් මුළුමනින්ම ප්‍රතික්ෂේප කිරීමට නොපැකිලිව ඉදිරිපත් විය යුතුය. එහෙත් අනවශ්‍ය ලෙස මතවාදී ගැටුම් ඇතිකර ගනිමින් එවැනි ඇඟිලි ගැසීම් සඳහා දොරටු විවෘත කර ගැනීම්වලින් අපි ද වැළකී සිටිය යුතු වෙමු. කොවිඩ් ආසාදිත මරණ සම්බන්ධයෙන් අප සිටින්නේ නිවැරැදි මතවාදයක නම් අපේ රට දෙසට ජාත්‍යන්තරයේ ඇඟිල්ල දිගුවීමට ඉඩක් නැත.

අමෙරිකාවේ ශ්‍රී ලංකා තානාපතිවරයාට අමෙරිකා සෙනෙට් සභිකයකු විසින් යොමුකර ඇති ලිපියේ සඳහන් වන්නේ කොවිඩ් 19 ආසාදිත පුද්ගලයන්ගේ මෘතදේහ බලහත්කාරයෙන් ආදාහනය කිරීම නවත්වන්නැයි එක්සත් ජාතීන්ගේ සංවිධානය ශ්‍රී ලංකා රජයට මහත් ඕනෑකමින් බලකර සිටින බවය. එම ලිපියෙන් තවදුරටත් පෙන්වා දී ඇත්තේ කොවිඩ් ආසාදිත මළසිරුරු භූමදානය කිරීමෙන් භූගත ජලයට වයිරසය එකතු වන බවට ශ්‍රී ලංකාවේ සෞඛ්‍ය අංශ ප්‍රකාශ කළත් ලෝක සෞඛ්‍ය සංවිධානයේ මාර්ගෝපදේශ මගින් භූමදානය සහ ආදාහනය යන දෙආකාරයටම අවසර ලබාදී තිබෙන බවය. එසේම ආසාදිත මළසිරුරු භූමදානයෙන් කොවිඩ් - 19 වයිරසය පැතිරෙන බවට කිසිදු ප්‍රමාණවත් සාක්ෂියක් නැතැයි ලෝක සෞඛ්‍ය සංවිධානය අවධාරණයෙන් සඳහන් කරන බවය.

ශ්‍රී ලංකාව තුළ මළසිරුරු අවසන් කටයුතු සිදුකිරීම සම්බන්ධයෙන් සැවොම පිළිගන්නා විශ්වාසයන් සහ සම්ප්‍රදායන් තිබේ. මේ බොහොමයක් සම්ප්‍රදායයන් ආගමික විශ්වාස සහ ඇදහීම් මත ගොඩනැංවුණු ඒවා වෙයි. එම සම්ප්‍රදායන්ට දීර්ඝ ඉතිහාසයක්ද තිබේ. මෙරට ජීවත්වන ජනතාවගෙන් අතිබහුතරය බෞද්ධ වන අතරම හින්දු-මුස්ලිම්, කතෝලික, ක්‍රිස්තියානි ඇතුළු වෙනත් ආගම් අදහන බොහෝ පිරිසක්ද රටේ වෙසෙති. මේ සියලු‍දෙනා මෙතෙක් කාලයක් මෘතදේහ අවසන් කටයුතු සිදුකළේ සෙසු පිරිස්වල විරෝධයකින් තොරවය. මේ තත්ත්වය වෙනස් කරනු ලැබුවේ කොවිඩ් වසංගතය මගිනි.

කොවිඩ් වසංගතය පැතිරුණු මුල් අවධියේ මේ රටේ සිදුවූ මරණ සංඛ්‍යාව සීමිත විය. එහෙත් එම සීමාව ඇතුළතද සිදුකෙරුණු පළමු මුස්ලිම් මෘතදේහය පිළිබඳ අවසන් කටයුත්තේදී මේ ගැටලු‍ව මතුවිය. එහෙත් ඒ කාලයේ ලෝක සෞඛ්‍ය සංවිධානයේ නිර්දේශ පැහැදිලි නොවීය. එසේම වයිරසයේ ව්‍යාප්තිය භූමදානය කෙරෙන මළසිරුරු හරහා සිදු නොවනු ඇති බවට සහතිකයක්ද නොවීය. මේ නිසා වෙනසකින් තොරව සියලු‍ මෘතදේහ ආදාහනය කිරීම හැර වෙනත් විකල්පයක් අපට නොතිබිණි. එහෙත් මේ වනවිට එම තත්ත්වය වෙනස් වී තිබේ.

ලෝක සෞඛ්‍ය සංවිධානයේ නිර්ණායක ඉතාම පැහැදිලිව ප්‍රකාශයට පත්කර තිබෙන අතර මෘතදේහ අවසන් කටයුතු සඳහා ඔවුන්ගේ නිර්දේශය වන්නේ ආදාහනය හෝ භූමදානයයි. මේ දෙආකාරයේදීම එය සිදුකළ යුතු තත්ත්වයන් සම්බන්ධව උපදෙස් පවා නිකුත් කර තිබේ. මෙරටේ දෙවැනි රැල්ල සමඟ වැඩිවූ මරණ සංඛ්‍යාව හේතුවෙන් අවසන් කටයුතු කිරීම සම්බන්ධයෙන් පැහැදිලි තීන්දුවක් ගතයුතුව තිබිණි. එම තීන්දුව රටේ කිසිදු ජාතික හෝ ආගමික හෝ පටහැණි නොවිය යුතු වීමද අවශ්‍ය විය. මේ සියලු‍ අංශ සලකා බලා අවසන් තීන්දුවක් ගැනීමට සෞඛ්‍ය අමාත්‍යංශය මගින් විශේෂඥ කමිටුවක්ද පත් කෙරිණි. එම කමිටුවේ වාර්තාව එළියට නොපැමිණි අතර රජයෙන් ප්‍රකාශ වූයේ ආදාහනය පමණක් නිර්දේශ කර ඇති බවය. මේ හේතූන් නිසා අපේ රටේ කොවිඩ් ආසාදිත මෘතදේහ අනිවාර්ය ආදාහනයකට යටත් කර ඇති බවට ජාත්‍යන්තරය තුළ මතයක් පැතිර ගියේය.

අපගේ වැටහීම වන්නේ අපේ රටේ ‘‘අනිවාර්ය ආදාහන’’ ප්‍රතිපත්තිය සම්බන්ධයෙන් සමාලෝචනය කිරීම තවමත් ප්‍රමාද නැති බවය. කොවිඩ් ආසාදිත මෘතදේහ ආදාහනය සම්බන්ධයෙන් ලෝක සෞඛ්‍ය සංවිධානයේ නිර්දේශ අනුගමනය නොකිරීමට ප්‍රමාණවත් හේතු නොතිබේ නම් භූමදානයට ඉඩදීම වැරැද්දක් නොවන බව අපගේ විශ්වාසයයි.

ජාත්‍යන්තර මහජන සෞඛ්‍ය මාර්ගෝපදේශවලට අනුව ආගමික විශ්වාසවලට සහ සංස්කෘතික සම්ප්‍රදායවලට ගරු කරන්නැයි ශ්‍රී ලංකාවට බල කර සිටින බව ඇමෙරිකා එක්සත් ජනපදය ප්‍රකාශ කරයි.

එසේ කිරීම තුළින් ජනතාවට සිය විශ්වාසවලට අනුකූලව ඔවුන්ගේ ආදරණීයන්ට නිසි පරිදි සමුදීමට අවස්ථාව උදා වනු ඇතැයි ද ඇමෙරිකා එක්සත් ජනපදය සඳහන් කරයි.

ඇමෙරිකා එක්සත් ජනපද රාජ්‍ය දෙපාර්තමේන්තුව වෙනුවෙන් එම දෙපාර්තමේන්තුවේ දකුණු හා මධ්‍යම ආසියානු කාර්යාලය ට්විටර් පණිවුඩයක් නිකුත් කරමින් මේ බව සඳහන් කර තිබේ.

‘කොවිඩ්-19’ ඛේදවාචකය හේතුවෙන් විශාල පිරිසකට ජීවිත අහිමි වී ඇතැයි ද එම ට්විටර් පණිවුඩයේ දැක්වේ.

එම ට්විටර් පණිවුඩය නිකුත් වීමෙන් පසු ශ්‍රී ලංකාවේ ඇමෙරිකානු තානාපතිනි ඇලෙයිනා බී. ටෙප්ලිට්ස් මහත්මිය ද ට්විටර් පණිවුඩයක් නිකුත් කර ඇත.

ශ්‍රී ලංකාවේ අනිවාර්ය ආදාහන ප්‍රතිපත්තිය සම්බන්ධයෙන් ඇමෙරිකාව සිය සැලකිල්ල සහ මහත් ඕනෑකම ශ්‍රී ලංකා රජයට දැනුම් දී ඇති බවත් ශ්‍රී ලංකාවේ බහුවිධ ප්‍රජාවල සම්ප්‍රදායවලට ගරැ කරන්නැයි බල කර සිටින බවත් ඇමෙරිකානු තානාපතිනිය සිය ට්විටර් පණිවුඩයේ සඳහන් කර ඇත.

ලෝක සෞඛ්‍ය සංවිධානයේ නිර්දේශවලට අනුව ‘කොවිඩ්-19’ ආසාදනය වී මිය යන පුද්ගලයන්ගේ සිරුරු භූමදානය කළ හැකි බව ද එම සංවිධානයේ මාර්ගෝපදේශ උපුටා දක්වමින් තානාපතිනිය තවදුරටත් සඳහන් කර ඇත.

කොවිඩ්-19’ ආසාදනය වීමෙන් මිය යන පුද්ගලයන්ගේ මළ සිරුරු සම්බන්ධයෙන් අවසන් කටයුතු කිරීමේදී ඇති එකම විකල්පය ආදාහනය යැයි තීරණය කිරීම මානව හිමිකම් උල්ලංඝනය කිරීමකට මුල පුරන බවට එක්සත් ජාතීන්ගේ මානව හිමිකම් විශේෂඥයන් අනතුරු අඟවා ඇතැයි ඇමෙරිකා එක්සත් ජනපදයේ සෙනට් සභිකයකු වන ක්‍රිස් වැන් හොලන් මහතා ප්‍රකාශ කරයි.

ඇමෙරිකාවේ ශ්‍රී ලංකා තානාපති රවිනාථ ආර්යසිංහ මහතා වෙත ලිපියක් යවමින් ඔහු මේ බව සඳහන් කර ඇත.

ක්‍රිස් වැන් හොලන් මහතා ඇමෙරිකා එක්සත් ජනපද සෙනට් මණ්ඩලයේ ශ්‍රී ලංකාව සම්බන්ධයෙන් පත් කර තිබෙන කමිටුවේ හිටපු සම සභාපතිවරයා ද වේ.
අනිවාර්ය ආදාහනය මුල් කරගනිමින් ක්‍රිස් වැන් හොලන් මහතා මෙලස රවිනාථ ආර්යසිංහ මහතාට ලිපිය යවා ඇත.

ක්‍රිස් වැන් හොලන් මහතා යැවූ ලිපියේ මෙසේ ද සඳහන් වේ.

මේ අතර නිව්යෝක් නුවර එක්සත් ජාතීන්ගේ සංවිධානයේ පුවත් දැනුම් දීම සඳහා සති අන්තයේ දහවල් පැවැති මාධ්‍ය හමුවකදී ද මේ කරුණ සම්බන්ධයෙන් අවධානය යොමු වී තිබේ.

කොවිඩ් -19 වයිරසය ආසාදනය වී මියයන පුද්ගලයින්ගේ සිරුරු අනිවාර්යයෙන් ආදාහනය කිරීමේ ප්‍රතිපත්තිය අවසන් කරන ලෙස එක්සත් ජාතීන්ගේ සංවිධානයේ මානව හිමිකම් පිළිබඳ විශේෂඥයින් සිව්දෙනෙකු ශ්‍රී ලංකා රජයෙන් ඉල්ලීමක් කර ඇත.

එක්සත් ජාතීන්ගේ සංවිධානයේ මානව හිමිකම් පිළිබඳ විශේෂ නියෝජිතයින් වන අහමඩ් ශහීඩ්, ෆර්නැන්ඩ් ඩී වැරෙන්නස්, ක්ලෙමන්ට් නයලෙට්සොස්සි වූලේ සහ ලැලෙන්ග් මොෆෝකෙන්ග් මෙම ඉල්ලීම සිදු කර ඇත.

එක්සත් ජාතීන්ගේ සංවිධානයේ එම විශේෂඥයින් සිව්දෙනා විශේෂ නිවේදනයක් නිකුත් කරමින් කියා සිටින්නේ කොවිඩ් මළසිරුරු ආදාහනය කිරීම මුස්ලිම් ජනතාව ඇතුළු සුළු ජාතිකයින්ගේ විශ්වාසයන්ට පටහැනි බවයි.

එසේම කොවිඩ් ආසාදිත හෝ සැක කෙරෙන පුද්ගලයින්ගේ මළ සිරුරු ආදාහනය කිරීම එකම විකල්පය ලෙස ශ්‍රී ලංකා රජය විසින් සැළකුව ද එම සිරුරු මිහිදන් කිරීමෙන් වයිරස ව්‍යාප්තිය ඉහළ යන බවට ශ්‍රී ලංකාවේ හෝ වෙනත් කිසිදු රටකින් වෛද්‍ය විද්‍යාත්මකව තහවුරු වී නොමැති බවද එම එක්සත් ජාතීන්ගේ විශේෂඥයෝ පෙන්වා දෙති.

කොරෝනා ආසාදිත මෘතදේහ සියල්ලම ආදාහනය කිරීමේ ශ‍්‍රී ලංකා රජයේ තීරණය හෙළා දකින බවත් , කොවිඩ් හේතුවෙන් මිය ගිය අයගේ මෘත දේහ ශ්‍රී ලංකාව තුළ ඒ ආකාරයෙන් ආදාහනය අනිවාර්ය කිරීමෙන් ජාතීන් අතර සුහදත්වයට බාධාවක් ඇතිවීම මෙන්ම එය මානව හිමිකම් කඩ කිරීමක් ද වන බවයි එම නිවේදනයේ සඳහන් වේ.

ඇතැම් අවස්ථාවලදී වාර්තා වල නිරවද්‍යතාව තහවුරු කිරීමට පවා කාලයක් ඉතිරි නොකර අදාළ ආදාහන කටයුතු සිදුකිරීම් ගැනද මෙම කමිටුව අවධානය යොමුකර ඇත.

එලෙස කොරෝනා වයිරසයෙන් මියයන පුද්ගලයන්ගේ දේහයන් සියල්ල ආදාහනය නතර කරන ලෙස රජයෙන් දැඩිව ඉල්ලා සිටින්නේ යැයිද එක්සත් ජාතීන්ගේ මානව හිමිකම් විශේෂඥ කණ්ඩායම නිකුත් කළ නිවේදනයේ වැඩිදුරටත් දැක්වේ.

කාන්තා හා ළමා සංවර්ධන පෙර පාසල්, ප්‍රාථමික අධ්‍යාපන පාසල් යටිතල පහසුකම් හා අධ්‍යාපන සේවා රාජ්‍ය අමාත්‍ය පියල් නිශාන්ත මහතාට, බිරිඳට‍ සහ දරුවාට ද කොරෝනා වයිරසය ආසාදිත වී ඇති බවට අද(18) තහවුරු වූ බව කළුතර සෞඛ්‍ය විද්‍යාතනයේ ප්‍රකාශකයෙක් පැවසීය.

කළුතර දිස්ත්‍රික් ලේකම් කාර්යාලයේ සහකාර අධ්‍යක්ෂකවරයෙකුට කොරෝනා ආසාදනයවීම හේතුවෙන් අද එම සැලසුම් අංශය තාවකාලිකව වසා එම සහකාර අධ්‍යක්ෂකවරයා සමඟ සමීපව කටයුතු කළ පුද්ගලයන් 40 කට ආසන්න සංඛ්‍යාවකට පී. සී. ආර්. පරීක්ෂණ කළ බව එම කාර්යාල ආරංචි මාර්ග සඳහන් කරයි.

ඉකුත් 15 වෙනිදා විශාල පිරිසකගේ සහභාගිත්වයෙන් කළුතර දිස්ත්‍රික් ලේකම් කාර්යාලයේ කමිටු රැස්වීමක් පවත්වා ඇති අතර එයට රාජ්‍ය අමාත්‍ය පියල් නිශාන්ත මහතා ඇතුළු දේශපාලනඥයන් ගණනාවක් මෙන්ම රාජ්‍ය නිලධාරීන් රැසක් ද සහභාගි වී ඇත.

එම කමිටු රැස්වීම පැවැත්වෙන අවස්ථාවේදී රාජ්‍ය අමාත්‍යවරයා සහකාර අධ්‍යක්ෂකවරයා අසලම පුටුවක වාඩි වී සිට ඇතැයි එම ආරංචි මාර්ග වැඩිදුර සඳහන් කරයි.

රාජ්‍ය අමාත්‍ය පියල් නිශාන්ත මහතා බිරිඳ හා දරුවා කොග්ගල ප්‍රතිකාර මධ්‍යස්ථානයක් වෙත යොමු කිරීමට නියමිතය.

State Minister Piyal Nishantha contracts COVID-19

Women and Child Development State Minister Piyal Nishantha tested COVID-19 positive, the State Minister confirmed.

Publishing a post on his official Facebook page, the State Minister said he has been infected with the virus and added that he would follow the instructions given by the health authorities.

“I also request those who came into contact with me in last few days, to take necessary steps and precaution as per the guideline given by health officials,” he said in the post.

He was confirmed to have been infected with the virus following a rapid antigen test.

Piyal Nishantha was also seen in the occasion held on January 14 to declare open Southeast Asia’s largest tyre manufacturing facility at Wagawatta in Horana, where President Gotabaya Rajapaksa and several Ministers and State Ministers were present.

Ministers Rohitha Abeygunawardena, Ramesh Pathirana, Mahinda Amaraweera, Wimal Weerawansa, State Minister Kanaka Herath and Defence Secretary, Gen.(Retd) Kamal Gunaratne were also among those present at the opening ceremony.

SL human rights situation seriously deteriorated under Gotabaya’s Govt.: Report shows

Sri Lanka’s human rights situation has seriously deteriorated under the administration of President Gotabaya Rajapaksa, Human Rights Watch said in its World Report 2021.

Government security forces have increased intimidation and surveillance of human rights activists, victims of past abuses, lawyers, and journalists. Minority Muslim and Tamil communities have faced discrimination and threats. The government pushed through passage of a constitutional amendment that undermines judicial independence and weakens oversight institutions, such as the Human Rights Commission of Sri Lanka. In February, Sri Lanka withdrew its commitments to the 2015 United Nations Human Rights Council for truth-seeking, accountability, and reconciliation following the country’s long civil war.

“The Rajapaksa administration has quickly reversed human rights gains of the previous government, making minorities more insecure, victims of past abuses fearful, and critics wary of speaking out,” said Meenakshi Ganguly, South Asia director at Human Rights Watch. “Even the limited progress on postwar reconciliation is being undone by a greater military role in governance and the government’s dismissal of its international commitments to truth and accountability.”

In the 761-page World Report 2021, its 31st edition, Human Rights Watch reviews human rights practices in more than 100 countries. In his introductory essay, Executive Director Kenneth Roth argues that the incoming United States administration should embed respect for human rights in its domestic and foreign policy in a way that is more likely to survive future US administrations that might be less committed to human rights. Roth emphasizes that even as the Trump administration mostly abandoned the protection of human rights, other governments stepped forward to champion rights. The Biden administration should seek to join, not supplant, this new collective effort.

President Rajapaksa has appointed people to senior positions, who, like himself, were implicated in war crimes during the civil war that ended in 2009, including the defense secretary, Kamal Gunaratne, and the chief of defense staff, Gen. Shavendra Silva. In February, the United States State Department announced that General Silva was ineligible to enter the US due to his alleged involvement in extrajudicial killings.

The Rajapaksa administration escalated surveillance and intimidation, targeting victims’ families and human rights defenders, as well as lawyers and journalists deemed critical of the government. These included victims and activists who engaged with the Human Rights Council.

After the outbreak of the Covid-19 pandemic, the government did little to address false accusations on social media that Muslims were deliberately spreading the virus and calls to boycott Muslim businesses. In March, the government began requiring cremation of all Covid-19 victims, disregarding Islamic tradition, though cremation was not required for public health. Four UN human rights experts criticized these requirements as violating religious freedom.

The UN high commissioner for human rights, Michelle Bachelet, accused the government of using Covid-19 to stifle freedom of expression after the authorities threatened to arrest anyone who “criticized” its handling of the pandemic. She condemned the pardon of one of the few soldiers ever convicted of serious abuses, and raised concerns about “appointments to key civilian roles of senior military officials allegedly involved in war crimes and crimes against humanity.”

The UN Human Rights Council will consider possible measures regarding Sri Lanka at its February-March 2021 session, including calls for an international accountability mechanism to pursue justice for past abuses.

“Concerned governments should do all they can to prevent Sri Lanka from returning to the ‘bad old days’ of rampant human rights violations,” Ganguly said. “Governments need to speak out against abuses and press for a UN Human Rights Council resolution that addresses accountability and the collection and preservation of evidence.”

Politics Behind Muslim Burial

No scientist or epidemiologist anywhere in the world has so far proved with solid evidence that corona virus would spread from buried corona-killed corpses. Only in Sri Lanka a so-called committee of health experts belonging to the establishment, expressed an opinion that because of high water level in the ground that virus has the potential to spread, if those died from it are buried. Hence, they recommended indiscriminate cremation hitting directly at religious sensitivity of Muslims. No amount of protest from local Muslims or from Muslim organizations abroad, and not even advice from WHO to the contrary could convince President Gotabaya Rajapaksa and his government to relent. The President maintains that unless the experts committee shows the green light he will not budge. This is the strongest demonstration yet of the one-country-one-law mantra.

In the meantime, the Muslim Minister of Justice fails to see the injustice committed to his community, and the Mufti or the chief shepherd preaches his herd how to bury the ashes after cremation. If you cannot change them join them appears to be the preferred course of action to these leaders. The community on the other hand is not prepared to listen.

The whole episode has nothing to do with science and epidemiology but with politics. The opinion expressed by the experts committee was manna from heaven to Buddhist supremacists who, since 2009 and especially after the Easter Massacre of 2019, are bent on seeking revenge on Muslim community. These supremacists are a pillar of strength to the Rajapaksa regime. Their ideology of a hegemonic Buddhist Sri Lanka dominates the thinking and philosophy of the professionals in President Gotabaya Rajapaksa’s Viyathmaga. It is that ideology which is the quintessence of today’s jathika chintanaya. Only a few days ago, when a rumour was spreading that the government was about to reconsider its decision to cremate Muslim bodies, an ageing Gunadasa Amarasekera, one of the architects of this ideology warned the government of relenting to Muslim demand. A couple of days ago Rev. Gnanasara in his usual anti-Muslim tone also reminded the law makers in the parliament of one-country-one-law.

There is no sign that the virus is going to disappear for at least another couple of years although its spread could be controlled through vaccination. Even then how cheaply and easily would Sri Lankans have access to that vaccine is unsure because of the country’s financial difficulties. Authorities are already opening the country for business, because Basil Rajapaksa feels that profit should not be allowed to suffer because of public health. Thus, based on pseudo-science and backed by jatika chintanaya cremation of Muslim bodies would continue under the pretext of an emergency. If the Mufti continues to preach his compromised solution of Islamically burying the ash, he could win the hearts and minds of the rulers but certainly not of his community.

The issue of cremating Muslim bodies and the proposed ban on cow slaughter are ideologically motivated and very soon one may expect Muslim personal laws also to fall under the ideology’s axe. It would be interesting how the Muslim Minister of justice would handle that issue when it comes before parliament. Meanwhile, the protagonists of this ideology would be watching closely at what their ‘predator’ friend China is doing to Uighur Muslims in Xinxiang. Leaked reports show how those Muslims are force fed with pig meat and their women shaved and the hair is used as raw material for manufacturing industrial products. Already the Chinese government has destroyed several mosques and Muslim burial places in the name of development. One could only hope that the situation in Sri Lanka would not descend to that barbaric level. Sri Lanka’s exceptionally successful management of multiculturalism before the colonial period was unique in the entire region of Asia.
However, what options do Muslims have to avoid further calamities? First of all, they should give up the idea that by going along with the ruling regime they could save their skin and survive peacefully under traumatic conditions. At the same time, there is no guarantee that they will have better prospects by joining the current opposition, because SJB and its parent UNP will also eventually fall prey to the current pernicious ideology to capture power. Therefore, Muslims and for that matter even Tamils should seek a third alternative. It should be an alternative that seeks to bring back democracy with all its innate qualities and preserve the country’s pluralist polity and culture. Thankfully, there is a significant cluster of saner and influential minds within the majority Sinhala Buddhists, including sections of the Sangha, who are wanting that to happen. It is the task of the Muslim intelligentsia to approach and join hands with them, introduce them to the community and work with them for a better Sri Lanka. It is not a change that is going to happen soon, but the foundations should be laid now for the future. The populist image of the current regime is bound to suffer in the face of looming economic disaster.

Muslim community is caught up in the current predicament because of its own ethnic politics. Both SLMC and ACMC should be dissolved forthwith and the community becomes part of a multi-ethnic, patriotic and democratic political party. If a ruling government is democratic, treats every community and citizen equally and protects the independence of judiciary, what does it matter whether Muslims and Tamils or for that matter even Sinhalese are represented in the legislature by their own men and women or by other community members? It is time to think afresh and outside the circle.
